The Customer in sending an item of property to loan.co.uk, agrees to be bound by the following terms and conditions (the "Terms"): The Terms are made between the following parties:
(1) loan.co.uk (the "Company") whose registered office is at 46 Alexandra Street, Southend-on-Sea, Essex, SS1 1BJ (company number: 05455171)(operating under Consumer Credit Licence No. 57726/4) (2) The person(s) transacting with the Company (the "Customer")
1. The Company agrees to lend fixed sums of money to the Customer secured on an item/items (the "Goods") belonging to the Customer (the "Loan").
2. The Loan shall always be at a fixed rate of interest and shall be for a fixed period of time.
3. The Loan remains subject to approval of the Customer's application by the Company and subject to the Customer signing a formal credit agreement which can be found at www.loan.co.uk
4. The credit agreement contains the information that the Company is obliged to supply to the Customer in relation to the Loan, including the duration, applicable %APR, how to cancel the Loan, early repayment of the Loan, the total amount repayable, and any charges that may be payable under the credit agreement if the Customer is in default.
5. The Company, by agreement with the Customer may also arrange for shipping of the Goods.
6. In sending any Goods to the Company, the Customer hereby warrants and represents that they have good and marketable title to the Goods, free of all encumbrances of any kind.
7. The Company may refuse to issue any offer of a Loan if the Company cannot be satisfied that the Goods belong to the Customer or if the Company is not satisfied as to the true identity of the Customer.
8. If the Customer chooses to use the Company's pre-paid shipping service, the Customer hereby authorises the Company to act as shipping agent to ship the Goods to and from the Company's place of business for the purposes of further appraisal by the Company's valuers in accordance with these Terms.
9. The Company agrees to provide basic packaging for the Goods which comprises of a padded envelope and Royal Mail Special Delivery tamper proof bag. It is the responsibility of the Customer to ensure that all Goods are securely and appropriately packaged, including the use of additional and/or item specific packaging.
10. The Company cannot be held responsible for damage to items which are received damaged in the post.
11. The Customer is advised that the Company has appointed Royal Mail as their agents to deliver the Goods. The Royal Mail Special Delivery Service provides insurance cover for loss or damage to the Goods in transit up to a market replacement value of £30,000. Full details of this are available from Royal Mail.
12. It is the responsibility of the Customer to arrange any insurance for Goods of value in excess of that stated at clause 11 above.
13. It is the responsibility of the Customer to obtain and retain a receipt for shipping of the Goods from the shipping agent. This receipt should include a unique tracking code. This receipt is required for any insurance claim.
14. The Customer is also advised, prior to parting with any Goods to take and retain photograph(s) of the Goods as well as retain a document which will show ownership and the current replacement value of Your Property.
15. The Customer understands that the Company is not liable in any way if Royal Mail refuses any insurance claims in relation to the Goods.
16. Should any insurance claim arise out of any loss or damage suffered in shipping the Goods back to you, the replacement value(s) claimed will be according to our valuation of the Goods as described in Clause 18 below, whether the offer of a Loan has been accepted or not.
17. On receiving the Goods, the Company shall inspect the item(s), and compare the Goods to the original description supplied by the Customer, in order to confirm that they match.
18. The Company shall then, acting in good faith, value the Goods according to accepted industry standards and prevailing market rates, and on the assumption that the description provided by the Customer is completely accurate.
19. Should the Goods vary from the original description in a manner which affects the valuation, the Company may, in their absolute discretion, decline to make an offer of a Loan or make an offer of a Loan which is higher than the initial indicative offer given to the Customer.
20. The Company reserves the right at any time to amend any valuation or offer of a Loan given prior to the Loan being drawn down, for any reason, including but not limited to any difference in the actual quality of the Goods compared with the Company's understanding or due to changes in the market for such item(s).
21. The Company is not responsible for any telecommunications charges, digital television subscription or other network charges for the time you spend accessing www.loan.co.uk or in contacting the Company.
22. These Terms shall be governed and interpreted by English law.
23. The parties agree to submit to the exclusive jurisdiction of the English courts,
24. These Terms, the shipping terms and any credit agreement are in the English language. The Company undertakes to only communicate with the Customer in English during the duration of the Loan application process and whilst any Loan is outstanding.
25. If the Customer is not satisfied with any aspect of the Loan or the loan process, shipping they can, in the first instance email info@loan.co.uk, stating brief details of the complaint (ensuring that the Customer's account number is contained in any correspondence). The Company will acknowledge any complaint by email within 1 business day. The Company will investigate and send an initial response (including, where appropriate, an offer of redress). This should take no longer than five business days. If the complaint is not resolved by close of business on the fifth business day after the complaint is received, the Company will send a copy of this complaints handling procedure. If the Customer is not satisfied by the response, he/she must contact the Customer Services Manager, who will endeavour to respond by email within a further five business days. If the Customer is not satisfied with the response from the Customer Services Manager, he/she can thereafter email martinr@loan.co.uk, enclosing the responses already given. The Customer's email will then be referred to the Senior Officer, who will respond by email within a final five business days. Complaints about the lending process or the Loan that the Company cannot settle within 8 weeks of the complaint may ultimately be referred to the Financial Ombudsman Service. 27. If these Terms of any part of these Terms are found to be illegal or unenforceable, such finding will not affect the validity or enforceability of the remainder of the Terms.
28. The Customer agrees that all documents that may be sent electronically may be delivered to the Customer at the latest email address given to the Company, or in writing via any account that is set up accessible via www.easyborrow.co.uk.
29. The Customer confirms by sending the Goods to the Company that he/she is over 18 years of age.
